Documents test hole readings from the Owens Valley Secondary Project in the Bishop, California area during the 1920s-1930s by the U.S. Department of the Interior Reclamation Service. These documents were used as evidence in Hillside Water Co., et al. v. City of Los Angeles, and were submitted during October and November 1933. They are all loose-leaf photocopies grouped by the plaintiffs' exhibit numbers.

Series Scope and Contents

Contains legal briefs, correspondence, and reports. The following lawsuit descriptions are adapted from various Mono Lake Committee publications and memoranda.
NOTE: In the interest of space, lengthy briefs originally attached as exhibits to other briefs in the MLC Collection were removed and replaced with a form entitled "Processing Note," which details the title of the removed brief and where the original can be found within the collection.

Series Arrangement

This series is divided into a number of subseries, each of which represents the Mono Lake Committee's seven major lawsuits from 1979 to 1994. The titles used for each lawsuit/subseries are the common titles used by the MLC and others. Cases are arranged chronologically within each lawsuit/subseries.
 

Sub-Series 9.1. Public Trust Lawsuit 1979-1988

Sub-Series Scope and Contents

Brought before the Mono County Superior Court by the National Audubon Society (NAS), Mono Lake Committee (MLC), and others in 1979. The Public Trust Suit is the cornerstone of the legal efforts to protect Mono Lake. The Suit charged that the Los Angeles Department of Water and Power's (LADWP) water diversions violated the "Public Trust Doctrine." In 1983, the California Supreme Court ruled that the state has an obligation to protect places such as Mono Lake "as far as feasible," even if this means reconsidering past water allocation decisions. The court also ruled that the courts and the State Water Resource Control Board(SWRCB) have concurrent jurisdiction in cases of this kind.

Sub-Series Scope and Contents

Brought before the Inyo County Superior Court against LADWP by the Mammoth Fly Rodders in 1984 and later joined by the MLC, NAS, and California Trout (Cal Trout). The suit charged that LADWP's diversions violated the Public Trust Doctrine, California Fish and Game codes, and the California Environmental Quality Act (CEQA). In 1984 the court issued a temporary restraining order requiring LADWP to release 19 cubic feet per second (cfs) into lower Rush Creek. In 1985, the Mono County Superior Court issued a preliminary injunction that required LADWP to continue to release a flow of 19 cfs into Rush Creek to protect public trust resources.

Brought before the Mono County Superior Courtby the MLC in 1986 on the same grounds as the Rush Creek Lawsuit. The court granted a temporary restraining order that required LADWP to release a flow of up to 10 cfs into Lee Vining Creek. In 1987, the court issued a preliminary injunction that required LADWP to continue to release a flow of 4-5 cfs into Rush Creek to protect public trust resources.

On September 28, 1994, the SWRCB issued the landmark Decision 1631 (D-1631) amending LADWP's water diversion licenses in the Mono Basin. The purpose of the Water Board's decision was twofold: to comply with Fish and Game Codes 5937 & 5946, and to protect public trust values at Mono Lake as ordered by the California Supreme Court in 1983. D-1631 calls for a lake level of 6,392 feet, which will take about 20 years to achieve. During this period, some diversions will be allowed to Los Angeles. Once the lake reaches 6,392 feet, LADWP will be able to divert an average of 31,000 acre-feet of water, or about 1/3 of Los Angeles' historical diversion from the Mono Basin. The difference will be more than made up for by replacement water supplies. D-1631 orders LADWP to develop plans to restore waterfowl and stream habitat damaged as a result of diversions, and to pay implementation costs associated with the restoration.
