Scope and Contents

This series documents Sofaer's public legal practice as a law clerk for District of Columbia Circuit Judge J. Skelly Wright (1965-1966) and U.S. Supreme Court Justice William J. Brennan, Jr. (1966-1967), as Assistant United States Attorney in the Southern District of New York (1967-1969), as well as his scholarly and legal activities while on the faculty at Columbia Law School (1969-1979). The bulk of the series relates to Sofaer's large-scale research project on presidential war powers, as well as his role as a hearing officer in a 1975-1976 New York Department of Environmental Conservation enforcement hearing against the General Electric Company. The materials include notes, correspondence, speeches and writings, clippings, and legal documents.

A majority of materials stem from his large-scale research project on presidential war powers and his role as hearing officer in a 1975-1976 New York Department of Environmental Conservation enforcement hearing against the General Electric Company. Biographical / Historical

On September 5, 1975 the New York Department of Environmental Conservation initiated an enforcement proceeding against the General Electric Company for violating several sections of the Environmental Conservation Law. The Department of Environmental Conservation accused GE of discharging polychlorinated biphenyls (PCBs) into the Hudson River, polluting the river and harming fish life. Sofaer was appointed hearing officer for the proceeding. On November 19, 1975 Sofaer granted the Natural Resources Defense Council's request to intervene. On February 9, 1976 Sofaer issued an interim opinion finding GE responsible for violating two sections of the Environmental Conservation Law by discharging PCBs. After several months of further discovery and remedial hearings, Sofaer agreed to act as a mediator in the dispute and on September 7, 1976 Sofaer published his opinion, including the agreement that GE pay the Department $3 million, devoting $1 million to research on eliminating PCBs, and contributing to ongoing monitoring of the Hudson River for these pollutants.

Biographical / Historical

In 1971, Sofaer was appointed as project director for an American Bar Association-sponsored study "on the respective powers under the Constitution of the President and of Congress to enter into and conduct war." Over the next eight years, Sofaer and the students in his Columbia Law School War Powers Seminar pursued this question by investigating armed conflicts during the first 40 years of United States history. A book resulting from this research, War, Foreign Affairs, and Constitutional Power: The Origins, was published in 1976.

Sharon v. Time, Inc.

Scope and Contents

In February 1983, former Israeli Minister of Defense Ariel Sharon sued Time, Inc. for libel in response to an article published in Time's February 21, 1983 issue. Materials include copies of the Final Report issued on February 7, 1983 detailing the inquiry by the Kahan Commission into a massacre that occurred at refugee camps in Beirut, Lebanon. This document was central to Sharon's claim as Time had used the report for a large portion of their discussion related to Sharon. Also included are trial materials for both the Defendant (Time) and the Plaintiff (Sharon) legal teams such as exhibits, memoranda, and discovery. Additionally, the file includes depositions of witnesses including former ambassador Morris Draper and Time correspondents David Halevy and Robert Slater, jury instructions, settlement drafts, and trial transcripts. Scope and Contents

This series consists of materials related to Sofaer's time serving as Legal Adviser for the United States Department of State from 1985-1990. The series is divided into the following subseries: Biographical File, Diaries, Administrative File, Correspondence, Speeches and Writing, Subject File, Clippings, and Calendars. Subjects of note include ADS's work negotiating the borderland dispute between Israel and Egypt at Taba, the investigation and trial of Johnathan Pollard, and the Iran-Contra hearings. Additionally, the series includes handwritten notes and correspondence regarding the Intermediate-Range Nuclear Forces Treaty and Sofaer's reinterpretation of the Anti-Ballistic Missile Treaty. Materials include handwritten notes, memoranda, correspondence, briefing materials, clippings, speeches, and research materials. Some materials fall outside of the main timeframe of the series, but are related to Sofaer's work on these topics during this period of his life.

Scope and Contents

This series contains materials related to Sofaer's legal work in the private sector from 1990 to 2018. From 1990 to 1994, Sofaer worked for the law firm Hughes Hubbard & Reed. Following his move to the Hoover Institution in 1994, he continued to practice law and served as an arbitrator or expert witness in several cases. This series is divided into the subseries Diaries, Case Files, Correspondence, Speeches and Writings, Subject Files, and Calendars. The Case File subseries is divided into two categories: Hughes Hubbard & Reed and Stanford. Subjects of note include Sofaer's representation of Libya in the settlement negotiations following the bombing of Pan Am Flight 103 in 1988. Additional subjects include the mediations over state water-use rights of the Colorado River and Sofaer's service on the United States Airline Commission. Materials include memoranda, briefing materials, handwritten notes, and trial preparation materials.
