Will of Anastacio Chaboya 25 November 1852

Scope and Contents note

In 1844 Anastacio Chaboya received a land grant along the Cosumnes and San Joaquin rivers. Before he died in 1852, he filed a claim with the Land Commissioners office for the grant. Unbeknownst to him, Chaboya's wife had sold their land to Charles Weber. Chaboya therefore included in his will a wish to satisfy a debt of $5,000 to Weber, who had paid his wife for the land. Since Chaboya had not intended to sell the land, he wanted his heirs to repay Weber with cattle he was owed by Joaquin Ortega and any other property his heirs wanted to use. Prior to probating the will, the heirs sold their portions of the land and a case was brought to trial to contest ownership. This case is described in Reports of Cases Determined in the Supreme Court of the State of California..., Volume 49. p. 497.
The will was witnessed by Jose Antonio de la Guerra, Joaquin de la Guerra, Pablo de la Guerra, and Ramon Mendoza.

Printed decree ordering the formation in Alta and Baja California of six permanent companies of artillery under a commandant inspector general. A table is included which gives the strength and other details concerning the companies stationed at San Francisco, Monterrey, Santa Barbara, San Diego, Fronteras, and Loreto.
