In this 1978 case the California Supreme Court in a 4-3 decision (Clark dissenting) overturned a California law making a prison sentence mandatory for use of a gun during commission of a crime. Public reaction resulted in Commission on Judicial Performance hearings. The following year the Court reheard the case and, in another 4-3 decision, reversed its earlier ruling
