Robert Alton Harris Case 1980-1993

Historical Background

Arguably Arthur Alarcón's most high-profile case as a court of appeals judge was that of Robert Alton Harris (January 15, 1953-April 21, 1992). Harris was an American criminal and murderer who was executed in San Quentin State Prison in 1992 in connection with the murders of two teenage boys in San Diego. His execution was the first in the state of California since 1967.
Arthur Alarcón served as a 9th Circuit Court of Appeals panel judge to consider Harris's habeas petitions. After the fourth stay of execution, the U.S. Supreme Court stated "No further stays of Robert Alton Harris's execution shall be entered by the Federal courts except upon order of this Cour." Harris died in the gas chamber at San Quentin on April 21, 1992.

Nordyke v King Case 2008-2011

Historical Background

In Nordyke v King, a lower court ruling was upheld as constitutional in Alameda County that banned guns on County property because it came under the doctrine that allows governments to restrict possession in "sensitive" places. The case was later taken en banc. At oral argument, the County stated that gun shows were not banned, and could be held with unloaded firearms if they were secured with cables. On June 1, 2012, the full appeals court ruled that the county law was constitutional, since it allowed gun shows to take place on the fairgrounds, with tight restrictions.

Ahmed Ressam Case

Historical Background

Ahmed Ressam is an Algerian al-Quaeda member who lived for a time in Montreal, Quebec, Canada. Later known as the Millenium Bomber, he was convicted in 2001 of planning to bomb the Los Angeles International Airport (LAX) on New Year's Eve 1999, as part of the foiled 2000 millenium attack plots. In 2005 he was sentenced to 22 years in prison, after cooperating with the government in testifying about al-Quaeda and associated terrorist networks. In 2007, a divided panel of the United States Court of Appeals for the Ninth Circuit in Seattle reversed Ressame's conviction on one of the charges, due to the majority's reading of the applicable law. The U.S. Supreme Court overturned the Ninth Circuit in an 8-1 decision on May 19, 2008, restoring the original convictions and sentence. On February 2, 2010, the Ninth Circuit Court of Appeals ruled that Ressam's 22-year sentence was too lenient, and the appellate court ordered that Ressam be re-sentenced by a different district court judge from the one who had handed down the original sentence. In October 2012, Ressam was re-sentenced to 37 years imprisonment and his serving his sentence at the maximum security prison in Colorado, ADX Florence.

L. Ewing Scott Case 1956-2012

Background Information

One of Judge Arthur Alarcón's most high profile cases occurred in 1959 when Alarcón was a deputy district attorney in California's first "no dead body" murder case. The conviction of L. Ewing Scott for the murder of his wife was based solely on circumstantial evidence and Scott was given a life sentence. He was released from prison in 1978 and later admitted to having committed the murder. He died in 1987 at age 91, more than 30 years after his wife first "went missing."

The Ninth Circuit Court of Appeals hears appeals of cases decided by executive branch agencies and federal trial courts in nine western states, the U.S. Territory of Guam, and the Commonwealth of the Northern Mariana Islands. The court normally meets monthly in Seattle, San Francisco, and Pasadena, California; every other month in Portland, Oregon; three times per year in Honolulu, Hawaii; and twice a year in Anchorage, Alaska.

Scope and Contents

Large flat scrapbook with loose pages containing chiefly newspaper clippings of Alarcon between 1960 and 1964. Some of the topics of the clippings include Alarcón's roles with Governor Edmund G. "Pat" Brown as Executive Secretary, Alarcón's appointment (by Brown) to Superior Judge, and Alarcón's selection by the governor as executive director of the Governor's Crime Commission on Narcotics (aka "Dope Commission). Other items in the scrapbook include invitations to Governor Brown's inaugural ball in 1963, an autographed photograph of Bernice Brown (in her inaugural gown), a folder of letters from Governor Brown to Arthur Alarcón, a photograph of a Mexican-American event or celebration, a photograph of the National College of State Trial Judges (1965), and a 1937 photograph of a Los Angeles Junior Orchestra depicting Alarcón with a violin.

Scope and Contents

Large scrapbook containing loose pages of newspaper clippings from the 1960s and 1970s-- some regarding Judge Alarcón himself, others on high-profile topics such as the L. Ewing Scott case (wife disappearance) in 1957; the assassination of Robert Kennedy by Sirhan Sirhan in 1968; the Manson family murders; narcotics; etc.
File containing a reporter's transcript of a 1967 discussion between Judge Alarcón and the lawyers for defendant Bryan E. Gibson in which Alarcón disqualified himself from the case; file also contains letters written in 1977 between Alarcón and J. Anthony Kline, Legal Affairs Secretary, discussing remarks made about "Pat" Brown at the earlier incident.
Folder of certicates and diplomas: Alarcón's B.A. (1949) from USC; Bachelor of Laws degree from USC (1951); certificate stating that Alarcón is admitted as attorney and counselor to the Southern District of California court (1952); certificate from the Supreme Court of California admitting Alarcón as an attorney and counselor at law in all the courts of the state (1952); a certificate of appointment of Executive Clemency and Extradition Secretary and Legal Advisor from Governor Brown (1961); certificate of appointment as Executive Secretary from Governor Brown (1962); certificate of appointment to Judge of the Superior Court of California in and for the County of Los Angeles (1964); certficate appointing Alarcón as Member, Adult Authority (1964); a certificate from UC Berkeley's California College of Trial Judges (1969); and a certificate of appreciation from USC for help in the preparation of a criminal law seminar (1972).

Large scrapbook containing newspaper clippings chiefly from 1951 to 1961 concerning several high-profile cases: The Herbert C. Legg perjury trial, Caryl Chessman's trial and long appeal, the L. Ewing Scott "no body" murder case, the Al Teitelbaum insurance fraud case, etc. Included with the scrapbook are several folders. One contains correspondence from the 1960s and 1970s; another holds various items of ephemera including a telegram announcing the death of President Kennedy; the third folder contains many black and white photographs from the 1960s including many as identified from "the White House." John F. Kennedy is shown speaking in one of the photographs.

Arthur Alarcón's Research Project on Tom Mooney

Scope and Contents note

Thomas "Tom" Mooney was an American political activist and labor leader, who was convicted with Warren K. Billings of the San Francisco Preparedness Day Bombing of 1916. Believed by many to have been wrongly convicted of a crime he did not commit, Mooney served 22 years in prison before being pardoned and released in 1939. He died in 1942 at 59 years old.
The research files in this series all center upon the trial of Tom Mooney and his associates--it appears that Alarcón may have planned on writing a book on the case. Most of the materials are photocopied articles from newspapers, journals, and from special collections in university libraries. There are a few files of handwritten and typed notes, and some email correspondence between Alarcón and various persons and institutions. Some of Alarcón's research materials involve other cases in which he was comparing particular aspects to that of Mooney's. Four document boxes comprise the series.

All of the files in this series have been kept in the order in which they had been arranged in the original boxes received by USC from Rollins Emerson, the archivist for the 9th Circuit U.S. Court of Appeals in San Francisco.
