Among the landmark cases with which this office dealt were Brown v. Califano and Adams v. Califano, Briscoe v. Bell, and the Voting Rights Act Project.

Historical Note

In 1980 Vilma Martinez changed the organizational structure of MALDEF, by creating three vice presidential positions. Morris Baller, who had been coordinator of litigation, was named Vice President of Legal Programs. In both positions Baller oversaw and coordinated MALDEF's litigation. His previous position with MALDEF was director of development litigation: his charge was to research and pursue new and appropriate litigation. He also was responsible for organizing MALDEF's opposition to federal legislative programs which compromised Mexican-American rights.

Scope and Contents Note

This subgroup contains files generated through national litigation activity; the regional offices kept the case files of most of the work that they did. Some cases have files in both this subgroup and in the files of the regional offices, reflecting the movement of the case or the issue through appellate courts.

Series 5. Chicana Rights Project

Historical Note

The Chicana Rights Project was initiated in the San Antonio office in 1973, with funding from the Ford Foundation, to address issues pertinent to Mexican American women; immigration, housing, birth control, access to abortion, and violence toward women were among the issues that the project addressed through litigation, lobbying and community outreach. CRP was directed by Patricia Vasquez from 1973 to 1979, by Carmen Estrada until mid-1981, and by Virginia Martinez through 1982. Project staff publicized Chicana issues through MALDEF-sponsored publications, legislative testimony, conference presentations, and radio and television shows. The project also worked with other women's groups to effect federal and local change through legislation. CRP also pursued social and economic justice through the courts, against employment discrimination, for a ban on involuntary sterilization, and for other issues affecting Chicana women. The Chicana Rights Project operated from the San Antonio office between 1973 and 1980. In 1980 and 1981 it was in both San Antonio and Los Angeles. In 1981 and 1982 the CRP was directed from the Chicago Regional Office. There are also CRP papers in the regional offices record group, in the aformementioned city subgroups, and in the main office files.

Scope and Contents Note

This series contains correspondence, memos, articles, reports, conference proceedings, bibliographies, speeches, press releases, mailing lists, newsletters and news clippings collected by the Chicana Rights Project during its first four years of operation. The materials concern several topics: abortion rights; education issues; health care; prisoners' rights; pending legislation; rape; legal resources for Mexican American women; sterilization and birth control and employment discrimination on the basis of sex, age, ethnicity and race. The materials in these files are from several sources; there are papers generated by the project in support of both legal and nonlegal work, but there are also many materials gleaned from other sources, to be used in research, policy formulation, coalition building and in CRP publications.

Historical Note

When Congress first wrote the legislation that created the Federal Comprehensive Education and Training Act (CETA), they wrote it in a way that did not address the situation of most unemployed women. The CRP worked with NOW lobbying to reopen hearings on the act. They succeeded in broadening the scope of who was helped by the legislation.

Scope and Contents Note

This series contains CETA guides, and documentation of the work done by the Chicana Rights Project and the National Organization for Women. There are complaint notes, legal research, surveys, statistics, sample complaints, client profiles, exhibits, government publications, clippings, and correspondence.

The Chicana Rights Project was initiated in the San Antonio office in 1973 and was supervised successively by Patricia Vasquez (1973-1979) and Carmen Estrada (1979-81). It addressed issues of immigration, housing, birth control and access to abortion, and violence toward women, through both litigation and community outreach. The Chicana Rights Project was initiated in the San Antonio office in 1973 and was supervised successively by Patricia Vasquez (1973-1979) and Carmen Estrada (1979-81). It addressed issues of immigration, housing, birth control and access to abortion, and violence toward women, through both litigation and community outreach. Through speeches, MALDEF-sponsored publications, legislative testimony, conference presentations and radio and television appearances, project staff communicated Chicana issues to the public. Employment opportunities for Chicanas were widened as MALDEF championed key cases. and monitored enforcement of court rulings and federal CETA guidelines.

Scope and Contents Note

These files contain correspondence, speeches, research notes, reports, conference papers, briefs, complaints, newspaper clippings, judicial orders, and interviews with undocumented women facing deportation. These were collected by the Chicana Rights Project's immigration project which worked to protect women from deportation.

Series 6. Educational Programs Office

Historical Note

MALDEF's Educational Programs Office, over which Peter D. Roos (1976-83), and Norma Cantú (1983), assisted by Ronald T. Vera, presided, supervised a series of programs to broaden educational opportunity for Mexican-Americans. These included loans and scholarships, a legal intern/extern program, and a program to introduce Latino junior high-school students to the demands of college. In addition, the office oversaw educational litigation to promote desegregation and equal access to programs and institute and protect bilingual education. MALDEF argued the landmark case Doe v. Plyler by which the exclusion of undocumented children from school was declared unconstitutional at the Supreme Court level. MALDEF also submitted an amicus brief in Bakke v. University of California Board of Regents, and monitored the effect of the Supreme Court's ruling on affirmative action.
The educational grant program was part of MALDEF's plan from the beginning. A percentage of the original Ford Foundation grant was earmarked for grants to Chicano law students; the rationale for this part of the grants was that scholarships would help to increase the pool of Chicano lawyers, and that Chicano lawyers would serve the same needs that MALDEF was created to serve. The program was administered by several people: Jaime Cervantes, Roberto de la Rosa, Victor Chavez, and Margarita Recinos were among the coordinators.

Scope and Contents Note

This series contains the research on which education litigation at MALDEF was based. There are collections of articles, photocopies of related cases, legal memoranda, copies of education bills from California and other states, copies of speeches made by MALDEF staff and others, and a good deal of information on effective schooling. The areas covered are those which the organization determined would most help Chicano children in schools, and those which could be affected by litigation. There is also a record of what educational legislation was being considered by the California legislature, and what bills passed.
