Inventory of the Governor's Office Records

1. DAILY JOURNALS AND DIARIES. 1857-1891.

Physical Description: 11 volumes

Scope and Content Note

The volumes in this series contain chronological entries recording the day-to-day transactions of the Governor's office. They are daily logs of actions taken by the Governor and hence the information is nearly identical to that found in the "Registers of Official Transactions," series entry 2. Entries include notations as to appointments and commissions made and signed, proclamations issued, applications for pardon granted or denied, actions on legislation, and occasional references to the Governor's itinerary. Each volume covers a single year and none is indexed. Ten of the eleven volumes pertain to the administrations of Downey, Stanford, Bartlett, Waterman, and Markham. In several cases entries are quite fragmentary.

2. REGISTERS OF OFFICIAL TRANSACTIONS. 1852-1903.

Scope and Content Note

The "Registers of Official Transactions" series is for the most part similar in content to the "Daily Journals and Diaries" described in series entry 1. A significant difference is the inclusion in the "Registers" of greater detail in the recorded day-to-day activities. While the majority of entries relate to appointments and commissions this series also includes considerable detail on such transactions as land patents signed and issued, legislative bills signed or vetoed, messages sent to the legislature, action on applications for pardon, commutations of sentence, reprieves, and extraditions, proclamations issued, and rewards offered.

Volumes 2-4 in this series, covering the years 1856-1859, appear to have been kept by the Secretary of State rather than the Governor's office. Entries in these three volumes include reference to articles of incorporation filed, journals, statutes, and other printed matter sent to individuals and to local government offices, state bond transactions, issuance of passports, state revenue stamp transactions, and the payment of state funds for services. Other entries are similar to those outlined in the first paragraph above but also include notations of fees and receipts collected. From volume 5 on, entries are restricted to Governor's office transactions and references to fees collected are no longer included. The majority of volumes pertain to individual administrations. All but three volumes are unindexed.

3. GOVERNOR'S CENTRAL FILES. 1943-date.

Scope and Content Note

The Governor, in his capacity as the state's chief executive officer, oversees the multiplicity of programs that comprise state government. Administration of the various programs generates a massive amount of documentation. The records so produced touch many aspects of the operations of the state agencies, including but not limited to the development of policy and programs. The Governor's Central Files are made up of three units: Administrative Files, Federal Files, and Legislative Files. Together they represent a large and concentrated source of documentation for study of California's state government.

The Administrative Files include the principal records documenting the interchange between the Governor's office and the other offices of state government. As the series title implies, the records in this category are primarily administrative in nature, generally exchanges at the agency or departmental director level, and reflect basic policy, procedure, and program matters. Administrative files also contain non-agency materials. Among the more significant are files of correspondence with civic and private organizations which document, in part, reaction to or opinions on the operations of state government. Other files include pertinent information on the Governor himself, including press releases, statements, speeches, articles, and newspaper clippings. Administrative files are arranged alphabetically by agency or organization and chronologically thereunder.

The Federal Files are similar to the Administrative Files except that the subject content bears on the relationship between the state and the federal government. Records in this series document federal-state programs, touching on their origin, organization, and implementation. The increasing impact of federal programs at the local level, along with the corresponding federal funding and revenue sharing, makes this series an invaluable resource for the study of federal-state relations. Federal files are arranged alphabetically by agency and chronologically thereunder.

The Legislative Files consist of documentation relating to the Governor's legislative program and to proposals and opinions of legislators and the public respecting legislation. Of particular importance in the Legislative Files is the Chaptered Bill File for the light it throws on legislative intent, on the arguments for and against a measure, and on the issues and interests involved respecting the bills enacted into law. For each bill the Governor signs there is a separate folder which normally contains analyses by the Legislative Counsel, Attorney General, the Governor's Legislative Secretary, and occasionally, the author. Additional support or opposition is sometimes found in the form of letters, petitions, telegrams, etc. The cover of each chapter folder serves as a checklist of agencies, organizations, and individuals to whom inquiries were directed for views and comments. Vetoed bill files are identical with the exception of the inclusion of the Governor's veto message.

Chaptered bills are arranged by chapter number for each session, vetoed bills by bill number. The index to the published Statutes for each session serves as a guide to the subject content of the Chaptered Bill File.

4. LETTERBOOKS. 1851-1887.

Scope and Content Note

A small but unique series in the Governor's office records is a collection of thirteen letterbooks comprising fragmentary correspondence of a number of nineteenth century governors. All but two of the letterbooks are copies of outgoing correspondence and in most cases they appear to be incomplete for any individual administration. The two volumes of letters received contain only some 60-70 items. Governors represented include McDougal, Downey, Stanford, Low, Haight, Booth, Pacheco, Irwin, and Perkins. Subject areas covered include a wide variety of topics, from the everyday conditions of state government operation to the suppression of Indian hostilities. A more detailed subject analysis is included in Part II. Indexes exist for only one volume.

5. PETITIONS TO THE GOVERNOR. 1850-1909.

Scope and Content Note

The right of the people to petition is inherent and no expression in the constitution or the codes relative thereto is necessary. The file of petitions addressed to the Governor is somewhat artificial in that some items perhaps belong more logically with the class of correspondence received. Relatively few in number, documents in this file fall into two categories. The larger number are petitions or letters requesting the appointment of some individual to a particular office. One grouping of over 100 petitions and letters concerns appointments to the State Board of Agriculture between the years 1887 and 1894. The second category relates to proposed legislation and includes petitions supporting or opposing specific measures. The petition file is arranged chronologically.

6. REPORTS TO THE GOVERNOR. 1850-1965. (GP series)

Scope and Content Note

The "Reports to the Governor" series takes its name from the annual, biennial, and special reports submitted to the Governor's office pursuant to various code requirements. This collection consists primarily of the manuscript reports of various state officers and agencies, most of which have been printed as part of the appendices to the Journals of the Senate and Assembly next issued after submission of the reports. The series also includes a variety of other records, including fragmentary correspondence received and sent, minutes and proceedings of state agencies of which the Governor was an ex officio member, transcripts of hearings and proceedings and related documentation of Governor appointed commissions and committees, etc. The State Archives has indexed the records in this series by agency and/or subject. Significant correspondence or other unique records pertaining to the administration of an individual governor are listed in Part II.

7. (STATE) AGENCY RECORDS. 1850-date.

Scope and Content Note

Agency administrative files on deposit in the State Archives frequently contain items involving interchanges with the Governor's office. For the period 1850-1900 there are numerous examples of Governor's office correspondence scattered among the files of other constitutional officers and to a lesser extent among existent departments or agencies. In recent times Governor's office correspondence in agency files is more abundant. The types of information in modern files is similar to that found in the Administrative File of the Governor's Central Files, series entry 3. This material relates in part to the development of policy and procedure at the highest levels of agency administration and frequently concerns departmental-related legislation and major programs. Agency files, however, may be lacking in completeness on any specific interchange. There is no precise way of identifying the volume of Governor's office materials in any agency's records. Indexing is fragmentary and varies from agency to agency. For examples of the presence of a substantial volume of Governor's records in state agency files see the descriptions of Land Office Records and Military Records, series entries 17 and 18.

8. APPOINTMENTS. 1849-date.

Scope and Content Note

The Governor's appointive power is based on Article V, Section 5 of the California Constitution and Section 1300 of the Government Code. His current appointive power is extensive and covers a wide range of offices (see Government Code index under: Governor--Appointments). The Governor is required to keep a record of "all appointments made by him, showing date of commission, and names of appointee and predecessor [Government Code, Section 12030 (c)]." This form of reporting is standard for nearly all appointment registers. Appointments are listed chronologically under title of office. With the exception of three volumes, each register pertains to the administration of but a single governor.

A far more complete register of Governor's appointments has been maintained by the Secretary of State's office. This is cited in Part II of this inventory as "Executive Appointments" (Secretary of State). The primary series of eleven volumes, the most recent of which (1958-date) is maintained in the Secretary of State's office, constitutes a master register for the period 1849-date. In content the registers are identical to those kept by the Governor's office. Appointments are listed by office and chronologically thereunder.

Miscellaneous registers of Governor's appointments also kept by the Secretary of State include: District Agricultural Association officers (1887-1910), four volumes; Foreign Commissioners of Deeds (1887-1938), three volumes; and three miscellaneous volumes relating to commissions of all types (1851-1858).

Oaths of office for all appointed and commissioned public officials, whose authority is not limited to any particular county, are filed with the office of the Secretary of State (Government Code, Section 363) and maintained in the State Archives. Oaths are filed by office, chronologically thereunder, and date from 1849 to the present. A master index controls all oaths on file.

9. NOTARY PUBLIC RECORDS. 1849-1958.

Scope and Content Note

The power to appoint and commission notaries public was a function of the Governor from 1850 (Statutes 1850, Chapter 41) to 1967 when the appointive power was transferred to the Secretary of State (Statutes 1967, Chapter 1139). Notary public records consist of two record groups, applications and registers of appointments.

Notary applications, 1849-1938 (96 cubic feet), take many forms, from simple letters by or on behalf of the applicant, to detailed statements of a person's background, political party, philosophy, and social status. In the period after 1853 (Statutes 1853, Chapter 80), when each county was allowed only a limited number of notaries, competition for the offices was brisk. Many application files contain numerous letters, petitions, and other documentation on behalf of a particular individual which may supply biographical data and information on local politics as well as throw light on the functions and the practical value of the holding of a notary commission. Applications are arranged by county for each year and alphabetically by name of applicant under the respective county.

Registers of appointments consist of two separate series, one kept by the Governor's office, 1852-1958 (26 volumes), the other by the Secretary of State, 1862-1924 (15 volumes). The entries in each volume of both series are arranged by county and the names of appointees, places of residence, and dates of appointment listed chronologically thereunder. Individual volumes also indicate the expiration dates of appointments as well as the names of persons succeeded.

10. RESIGNATIONS. 1849-1941.

Physical Description: 3 cubic feet

Scope and Content Note

The resignation of a public official commissioned by the Governor is submitted to the Governor in writing [Government Code, Section 1750 (b)]. Letters of resignation are [UNK] brief, one page statements. In some instances the reason for resignation is stated in more detail. Such resignations often reflect the impact of partisan politics and occasionally the economic and social conditions of the time as they affect the individual. The vast majority of resignations are from individuals holding notary commissions. Resignations of agency officials, legislators, and county judges are also to be found. Documentation commencing in 1895 includes Governor's office communications notifying the Secretary of State of resignations received and accepted. Resignations are arranged chronologically but are otherwise unindexed.

11. ORIGINAL LAWS. 1850-date.

Scope and Content Note

After the Governor approves a bill the signed document is deposited with the office of the Secretary of State where it becomes the official record of the statutory law of California (Government Code, Section 9510). The Secretary of State assigns a number, known as the chapter number, to each bill in the order in which it is received. For the period 1850-1972 there is one series of bill chapters for each session of the legislature. Beginning with the two-year session of 1973-1974, there are two series of bill chapter numbers per session, one for bills passed before December 31 of the first year of the session and one for those passed after such date. Resolutions are chaptered under a separate number sequence for each session. At the end of each session the original laws and resolutions are bound in volumes and transferred to the State Archives.

The volumes from 1850-1878 are in manuscript form; those from 1880-date are in printed form. A microfilm security copy is made and stored outside the State Capital. The index to the published statutes serves as a guide to the subject content of the original laws.

12. PROCLAMATIONS. 1849-date.

Scope and Content Note

The Governor's issuance of official proclamations, executive orders, and decrees is based on the executive powers inherent in Article V, Section 1 of the California Constitution and also on statutory law. Initially, proclamations were issued only for the purposes of declaring legal holidays and for calling general and special elections. As the powers and duties of the Governor's office increased, so did the use of the proclamation. Examples of modern day usage include agricultural quarantine (Agricultural Code, Section 5304) and closure of forest areas (Public Resources Code, Sections 4128, 4297-4298, 4423). The proclamation file is organized chronologically. A index is available which includes the subject of the proclamation, the date signed by the Governor, and the date filed with the Secretary of State. The original of all proclamations is filed with the Secretary of State's office and deposited in the State Archives.

13. OFFERS OF REWARDS. 1850-date.

Scope and Content Note

The Rewards file is a small but informative collection relating to crimes and law enforcement. Originally authorized by Statutes 1851, Chapter 119, the Governor's power to offer rewards is now defined in the Penal Code, Section 1547. The file includes petitions, letters, depositions, and other statements describing the nature of the crime and the person or persons responsible when known. Filed with the petitions are the Governor's offers of reward which includes a brief description of the crime and the perpetrators thereof. Printed reward posters for statewide distribution are also included in some instances. An index kept by the Secretary of State lists all rewards for the period 1856-1928. Rewards from the latter date to the present are included in the Proclamation File, series entry 12.

14. PRISON PAPERS. 1850-date.

Physical Description: 1200 cubic feet

Scope and Content Note

The Governor has the power to grant reprieves, pardons, commutations of sentence, after conviction, for all offenses except impeachment (California Constitution, Article V, Section 8). As part of this function the Governor is required to keep records of all applications for pardon or commutations of sentence "with a list of the official signatures and recommendations in favor of each application (Government Code, Section 12030)." In the operations of this power, and also in those functions pertaining to the extradition of prisoners to and from California, the Governor's office has created a mass of data pertaining to crime and punishment as well as biographical data on thousands of individuals.

The Prison Papers are composed of a number of record series, several of which are duplicated by near identical series maintained by the Secretary of State's office. The several record series include: San Quentin and Folsom Prison Registers (1851-1943); Applications for Pardon, Historical Case Files (1850-ca. 1935); Executive Clemency Case Files (ca. 1930-date); Extreme Penalty Case Files (ca. 1948-date); Application for Pardon Registers (1876-1944); Pardons (1858-1966); Executive Pardons (1872-1903); Commutation of Sentence (1876-1907); Prison Discharges (1868-1886); Executive Orders to Release (1883-1891); Restoration to Citizenship (1887-1897); Extradition Case Files (ca. 1856-date); and Record of Requisitions, Warrant of Rendition, Extraditions (1906-1967).

Prison registers are descriptive lists of inmates received. Separate registers were kept for San Quentin (1851-1942), Folsom (1880-1943), Preston School of Industry, Ione (1894-1912), Fred C. Nelles School for Boys, Whittier (1891-1916), and the California School for Girls, Ventura (1914-1918). Each register includes the prisoner's name, prison number, initial date of confinement, nativity, crime committed, county sent from, age, occupation, height, complexion, color of eyes and hair, and a space for comments. The latter entry was used for noting dates of escape, recapture, pardon, death, and notable physical characteristics. Most registers are indexed.

Records relating to pardons, commutations, and reprieves include the Applications for Pardon, Historical Case Files; Executive Clemency and Extreme Penalty case files, and several bound series. Collectively these series constitute the largest part of the Prison Papers Record Group. With the exception of the bound records all series include the same general types of documentation.

The Applications for Pardon, Historical Case Files (1850-ca. 1935) consist of a file on each person for whom the Governor has received a request for a pardon or commutation. In the course of carrying out the pardoning process unique records often accumulate. Frequently present in these files are transcripts and other legal documentation from the trial courts and petitions and letters from friends, relatives, and others seeking the individual's pardon. Such records often provide informative biographical and character information as well as insight into the background of the crime and its social and economic setting. Other records include prison and correctional institution statements on the prisoners qualifications for pardon, parole, etc., and records of official action taken by the Governor's office, the latter documentation frequently duplicating information as found in one or more of the bound series.

The Historical Case Files are fully indexed by name of prisoner. Following the name of the prisoner the index indicates the character of the crime and the county of commitment. Executive Clemency Case Files (ca. 1930-date) are a continuation of the Historical Case Files. Extreme Penalty Case Files (ca. 1948-date) again are identical in content except that they pertain to prisoners subject to the death penalty. Executive Clemency and Extreme Penalty case files are unindexed, but within subdivisions are arranged alphabetically. Transfers from the Governor's office are made on a irregular basis. Records in the Executive and Extreme Penalty series less than 25 years old are closed to public use unless permission is first obtained from the Governor's office in writing [For exemption from disclosure, see Government Code, Section 6268].

Several bound series--Applications for Pardons, Pardons, Executive Pardons, Commutation of Sentence, Prison Discharges, Executive Orders to Release, and Restoration to Citizenship--record the Governor's actions; they supplement the Historical Case Files described above. The Secretary of State's office maintained duplicate series of the following: Executive Pardons (1864-1892); Commutation of Sentence (1876-1903); Order to Release (1899-1938); and Restoration to Citizenship (1887-1906). Only a few volumes in each series are indexed. The official record of each pardon, commutation, or reprieve granted is also filed with the Secretary of State (Government Code, Section 12162). All pardons in this series are indexed.

Subject to the provisions of the Penal Code, it is the duty of the Governor to have arrested and deliver up "to the executive authority of any other State any person charged in that State with treason, felony, or other crime, who has fled from justice and is found in this State (Penal Code, Section 1548.1)."

Reciprocal agreements are in force with respect to extradition of criminals to California from other states. Extradition Case Files, as developed by the Governor's office, may include the demand for extradition, a copy of the indictment or information, an affidavit made before a magistrate charging the person demanded with having committed a crime, or copy of a judgment of conviction or of a sentence imposed in execution thereof. Extradition files for the period 1856-1930 are indexed. Files for ca. 1930-date are unindexed, but within subdivisions are arranged alphabetically by state and thereunder by name of prisoner. The bound series, Record of Requisitions, Warrant of Rendition, Extradition (1906-1967), is an alphabetical and chronological register of actions taken by the Governor's office relating to extraditions.

Prison Operations Records (1858-1944) include a number of distinct series relating to the operations of San Quentin and Folsom State prisons, and to a lesser extent the operations of Preston School of Industry, Ione, and the Fred C. Nelles School for Boys, Whittier. Record series include: monthly descriptive lists of prisoners received, discharged, pardoned, restored to citizenship, escaped, recaptured, and deceased; monthly commissary reports of provisions, clothing, bedding, etc., purchased and distributed; quarterly reports of institutional receipts and expenditures; warden's monthly reports to the Controller of monies paid into the state treasury from the sale of prison manufactured goods and from prison contract labor; and miscellaneous correspondence between the Governor's office and prison officials relative to overall operations of the prison system. A separate unpublished inventory is available in the State Archives for this portion of the Prison Papers.

No reference to the Prison Operations Records is included in Part II.

15. GOVERNOR'S MANSION. 1869-1970.

Physical Description: Undetermined volume

Scope and Content Note

The State of California has had two Executive Mansions. The first was built under the provisions of 1870 legislation (Statutes 1869-70, Chapter 496). Located on the grounds of the present Capitol Park, the structure was never used as a Governor's Mansion. In 1874 the building was remodeled for the use of the Office of State Printing which remained there until 1923. The California State Archieves includes within its collections a set of pen and ink drawings detailing the facades and principal floor plans of the first mansion.

The second mansion was a 15 room Victorian Gothic structure at 16th and H streets originally built in 1877-1878 for Albert Gallatin, a Sacramento hardware merchant. Purchased by the state for $32,500 in 1903, the mansion was the residence of 13 California Governors until it was determined to be unsuitable for occupancy in 1967. The mansion is now a State Historical Landmark operated by the Department of Parks and Recreation. Records in the State Archives on the second mansion include blueprints, numerous architectural drawings on various interior and exterior remodeling projects, Controller's claim schedules for the purchase of furniture and other furnishings by California's First Ladies, property survey reports, and the original deed of purchase (State Lands Deed 62-78) from Joseph Steffens, dated August 6, 1903.

In 1974 a new Governor's Mansion was in the planning stages. Land bordering on and overlooking the American River in Carmichael, to the northeast of Sacramento, was purchased and deeded to the state through the efforts of Citizens for a Residence for California Governors, a private organization. The State Archives accessioned selected papers of this organization as a part of a general information file on the new mansion.

16. GOVERNOR'S PORTRAITS. 1956.

Physical Description: 30 color negatives

Scope and Content Note

The Department of General Services is charged with the hiring of competent artists to paint oil portraits of each Governor and to display said paintings in the State Capitol (Government Code, Section 14623). In 1956 color negatives were made of each portrait, from Burnett to Warren. These negatives, along with miscellaneous other photographs of California's governors are on file in the State Archives. (The California Section of the State Library, Sacramento 95814, has a set of 8" × 10" black and white negatives of the Governor's portraits from which prints may be ordered.)

17. LAND OFFICE PAPERS. 1852-1932.

Physical Description: 38 cubic feet

Scope and Content Note

Among the papers generated by the Governor's office are records relating to the sale and disposal of state lands acquired from the federal government. The Governor's role in such land transactions was and is relatively minor, limited principally to the affixing of his signature to land patents and to certain classes of communications with the U. S. Land Office. Most of the latter communications were answered or drafted by the California Surveyor General, who was the register of state lands, and forwarded to the Governor for his signature or attention. The inclusion of the Land Office Papers as a part of the Governor's office files is therefore somewhat questionable. The greatest percentage of records making up this series originated with the register of state lands and other state officers. A determination of the true origin of this collection awaits analysis by the State Lands Division. For the above reasons specific references to the Land Office Papers are not included in Part II.

Classes of records making up the Land Office Papers include: county treasurer's reports to the register of state lands of receipts for the sale of swamp and overflowed and school lands (1859-1903); county treasurer's reports to the State Controller of receipts for the sale of swamp and overflowed and school and seminary lands (1855-1878); cancelled school land patents (1852-1910); register's certificates, issued in connection with applications for sales of public lands, numbers 1-18482 (1880-1932); certificates of purchase (1856-1880); certificates of transfer (1864-1870); Board of Tide Land Commissioners receipts (1865-1871).

Also contain deeds (1854-1883); monthly reports of land patents signed by the Governor (1887-1898); land sold for taxes (1877-1907); abstracts of titles, San Francisco (1865-1871); correspondence relative to transmittal of land lists and patents (1866-1932); cancelled letters patent on swamp and overflowed lands; correspondence concerning grant of patents to school lands for mining purposes (1874-1900); applications to the U. S. Land Office for in lieu substitutions for school lands (1858-1896); San Francisco water lot surveys (1853-1883); affidavits declaring certain lands as swamp and overflowed lands (1855-1885); and miscellaneous land office records (1856-1932).

18. MILITARY RECORDS. 1849-1940.

Physical Description: 295 cubic feet

Scope and Content Note

The Governor as "commander-in-chief of a militia that shall be provided by statute" (from 1849-1966 he was "commander-in-chief of the militia, the army and navy, of this State"), has wide powers in the organization of military units, commissioning of officers, and calling the militia into active service (Constitution, Article V, Section 7; Military and Veterans Code, Sections 140, 146, 211, 220). The Military Record Group in the State Archives, made up of records generated by the California Adjutant General's office, contains a large although undetermined quantity of Governor's office correspondence. The greatest portion of these records cover the period 1850-1900 and deal with the organization and maintenance of the State Militia, which later became the National Guard, the supply of arms and equipment, and the nomination, appointment, and commissioning of officers.

The 1850's and 1860's were particularly active years in the history of the California State Militia. The decade of the 1850's witnessed a large number of military campaigns to suppress Indian hostilities. Individual campaigns ranged as far afield as the Oregon border, the deserts of Southern California, and the eastern slope of the Sierra Nevada. Requests from citizens for protection, arms, and authority to form militia units for self-protection were addressed to the Governor's office. Coordination was directed through the Adjutant General's office. A small grouping of records (2 cubic feet), commonly referred to as the Indian War Papers, is available in the California State Archives on various campaigns for the period 1850-1880. Arrangement of the Indian War Papers is by specific campaigns and/or subject and chronologically thereunder.

The Civil War dominated the 1860's and the impact on the State Militia was considerable. More than 16,000 Californians volunteered for active service, occupying forts, posts, and strategic roads and sites in the western states and territories, from Puget Sound to San Elizario, Texas [Richard H. Orton, Records of California Men in the War of the Rebellion, 1861 to 1867 (Sacramento, 1890), p. 5].

Governor's office correspondence and other records filed in the Military Record Group is partially catalogued although a shelf list roughly describing each file box is available. Until a detailed cataloging program is completed, however, search for gubernatorial materials in the military records will continue to be time-consuming.

2. Registers of Official Transactions, 1849-1851

Governor Edmund G. Brown, upon leaving office, donated the major portion of his papers to the Bancroft Library, University of California, Berkeley. The Governor's Chaptered Bill File, consisting of some 100 cubic feet, was the principal element deposited in the State Archives. In 1974 the Bancroft Library transferred to the State Archives a duplicate file of administrative correspondence. Referred to as the "Green File," this series consists of approximately 250 cubic feet of carbon copies of all outgoing correspondence. The series is arranged alphabetically by agency and subject.
