Series 9 Legal Documents

Physical Description: Cartons 16-31; Box 5; Box 7, folders 5-19; Oversize folder 1

Arrangement

Further divided into eight subseries: 9.1 Parole Cases; 9.2 People of California vs. Eldridge Cleaver; 9.3 People of California vs. Eldridge Cleaver- Related Cases; 9.4 Federal Surveillance Cases; 9.5 FBI Files; 9.6 Beverly Axelrod; 9.7 General Legal Files; 9.8 California Department of Corrections Records

Scope and Content Note

Most materials relate, either tangentially or directly, to the case surrounding the 1968 shootout in Oakland ( People of California vs. Eldridge Cleaver), for which Cleaver was tried after returning from exile. In addition to evidence from the 1968 shootout (witness statements, diagrams, etc.), the files include briefs and other legal documents regarding the cases of other Black Panthers tried for the shootout while Cleaver was in exile. Also included are legal documents relating to the various appeals Cleaver submitted in relation to this case and to his legal case against the federal government requesting the release of his FBI files, to support his contention that he would not have received a fair trial in 1968, thus defending his choice of exile over trial. In addition to the legal documents related to this fight, the collection includes the released and excised copies of FBI files on Kathleen and Eldridge Cleaver, the Black Panther Party and other individuals associated with the Black Panther Party.
