Acquisition History

The State Archives received these records in accordance with California Government Code 9080(b) which requires legislative committees to transfer their records to the State Archives when they are no longer needed by the committee.

Committee History

House Resolution 7 created the Assembly Committee on Banking, Finance and Bonded Indebtedness on January 18, 1991. Prior to HR 7 the current functions of the committee were joined with the Insurance Committee as the Assembly Finance and Insurance Committee. For the 1993-1994 session, the committee was formed as the Assembly Banking, Finance, and Public Investment with House Resolution 13 on March 11, 1993. House Resolution 34 on January 10, 1994 changed the committee to the Assembly Banking and Finance Committee and created a separate standing committee for insurance. The committee was henceforth known solely as the Assembly Committee on Banking and Finance. Since 1991 the committee has had as many as 16 members (1993-1994) and as few as 9 (1999-2000 and 2005-2006). This committee handles all of the legislation that pertains to the regulation of the banking and finance industry as well as consumer financial protections.
Since the 1991-1992 session, the purpose and responsibilities of the committee have not changed significantly. The committee's responsibilities include California pollution control financing authority, charitable and cooperative corporate law, consumer finance and credit reporting, corporate securities law, financial institutions, foreign banking, foreign investment in California financial institutions, formation of new corporate entities, franchises (except for dispute arbitrations between franchisor and franchisee), industrial development bonds, insurance finance and lending practices, real property finance, and state investment practices.

Scope and Content

The Assembly Banking and Finance Committee Records consist of approximately 19 cubic feet of records. The records cover the years 1991-2008, and are composed of bill files, hearing files, and a correspondence file. It is anticipated that the Archives will receive further records from the Assembly Banking and Finance Committee as it remains a functional standing committee in the California State Assembly. Researchers should inquire with the reference archivist about recently received, unprocessed records of the committee.
The bill files consist of 17 cubic feet of textual records spanning the years 1991-2008. The majority of the bill files pertain to financial institution fees and taxation, deferred deposit loans, consumer credit reports, identity theft, acquisition of CA financial institutions by foreign entities, and predatory lending practices.
Of the various topics addressed within the committee bill files, controversial issues such as deferred deposit loans and corporate tax law as it pertains to credit unions generated a great deal of public comment. The file for AB1226 (2003-2004) contains many letters, especially from credit union management and members, in opposition of the increased tax burden on credit unions the passage of the bill would have imposed.
The hearing files consist of approximately 2 cubic feet of textual records, 5 video cassettes, 1 video disc, 14 audio cassettes, and 3 audio discs. Topics of particular interest are hearing files relating to the merger and acquisition of California financial institutions by foreign entities and tribal governments (1997-1999), and the hearing on predatory lending practices (2/21/2001).

Access to audiovisual material requires the production of use copies.

Scope and Content Note

Hearing files may consist of agendas, transcripts, audio discs/cassettes, video discs/cassettes, and background information for regular session hearings, as well as interim hearings and select joint hearings. Audiovisual materials have been separated into a cold storage vault for preservation purposes. Separation sheets within the hearing files will alert the researcher to the existence of such material.
Of particular interest are hearing files relating to the merger and acquisition of California financial institutions by foreign entities and tribal governments (1997-1999) and the hearing on predatory lending practices (2/21/2001). In addition to the routine hearing of bills, researchers may also be interested in other hearing file topics, which include identity theft, ATM and bank fees, federal preemption, and credit reporting.

The correspondence file consists of letters written or received by committee chair Patricia Wiggins in 2003. The letters are mostly congratulations to other members of the committee on their appointment, requests to the speaker for changes of committee meeting date/place, consultant reports about pending legislation, responses to citizen letters, and other letters of an administrative nature.
